Navigable Waters

April 20th 1994

  • The states claim jurisdiction over the inland lakes and streams. The states have control over the inland, lakes and streams, when they have a monetary or proprietary interest in the land beneath the water. And then only the portion of the land and water they have a vested interest in, no more and no less. The owner of the land under the water owns the water, and the fish. If it is a river or stream as the water passes over the bottom land, it belongs to land owner.
