- This is a
decision of the department of the interior.
I find these decisions are not found in the
law libraries. To get this one, I went to my
U.S. Rep. Read it very carefully. This
proves, when the U. S. patents the land, all
title and control passes to the patentee.
The word "generally" is used. What
they are referring to is patents that have
covenants on them. Go to PATENTS and you
will see patents with covenants. The only
place a covenant can be on land is in the
patent proceedings. "the patent
proceedings consist of the patent and the
act, or acts of congress mentioned on the
patent." All other covenants are a
"collateral attack" on the patent.
