the plaintiff is violating my civil rights.
I
will do my best to present all of my evidence as clearly as I can and follow the
court’s rules to the best of my ability.

Honor. I am Kenneth D. Widgren and I am representing myself today because
the plaintiff is violating my civil rights. I
will do my best to present all of my evidence as clearly as I can and follow the
court’s rules to the best of my ability. Your
Honor, the matter that is brought forth before this Honorable Court by Maple
Grove Township, a Municipal Corporation, violates Federal Statutes and the
Constitution of the United States. I
do not, nor have I ever had, a contract with Maple Grove Township, nor does
Maple Grove Township have a proprietary or monetary interest whatsoever in my
private property. I do not believe
that Maple Grove Township has lawful jurisdiction over my private property.
It is a principle of law that once challenged, the person asserting
jurisdiction must prove that jurisdiction exists as a matter of law.
Title 5 of the US Code, Section 556(d) states “When
jurisdiction is challenged, the burden of proof is on the government. Also for the
record, under UCC (Uniform Commercial
Code) 3-505 “The party to whom presentment is made, may, without
dishonor require (a) exhibition of the instrument, (b) identification of the
person making the presentment and evidence of his authority to make it.” UCC
(Uniform Commercial Code) 3-401 “No
person is liable on an instrument unless his signature appears thereon.” USC Title 42: Civil Rights
Section 1982 - Property Rights of Citizens USC
Title 42: Civil Rights Section 1983 – Civil Action for Deprivation of Rights Action at law, suit in equity, or proceeding for redress,
may be taken against every person who, under color of any statute, ordinance,
regulation, custom, or usage, causes any citizen to be subjected to the
deprivation of any rights, privileges, or immunities secured by the
Constitution. USC
Title 42: Civil Rights Section 1986 – Action For Neglect To Prevent Every person, who, having knowledge or the wrongs conspired
to be done, and having power to prevent the same, neglects, or refuses to do so,
shall be liable to the injured party for all damages caused by such wrongful
act. USC
Title 42: Civil Rights Section 241 – Conspiracy Against Rights Severe penalties for conspiracy to injure another in their
exercise of rights secured by the Constitution. USC
Title 18: Civil Rights Section 242 – Deprivation of Rights Under Color of Law Severe penalties for anyone, who, under color of law,
statute, ordinance, regulation, or custom subjects another to the deprivation of
rights, privileges, or immunities secured by the Constitution. Maple Grove Township has again brought this matter before
this Honorable Court when this same matter was decided in this very Court, Case
Nbr: 3-00140-ON 1, May 27, 2003. The
Motion for Dismissal was granted. Maple
Grove Township, in their zeal to deny me my civil rights are motivated by their
desire to intimidate and persecute me under the color of law. Article
IV (4), The Bill of Rights “The right of the people to be secure in their persons,
houses, papers and effects against unreasonable seizures shall not be
violated.” Mr. Lenz stated under oath that he trespassed on my property
on more than one occasion. Mr. Lenz also trespassed with the State
Building Inspector, Mr. Elsie. Both Mr. Lenz and Mr. Elsie did not have my
consent to enter my private property nor did they present me with a search
warrant. Mr. Beldo, the Assessor on April 12, 2003 has also admitted to
trespassing. If the Zoning Administrator, Building Inspector Assessor did not
have Legal Authority to enter my property, then any information they obtained
without benefit of a search warrant or my consent was and is illegal.
Therefore, all information obtained by the prosecution is to be stricken because of an illegal search. Article
V (5), The Bill of Rights “No person shall be deprived of life, liberty or property
without due process of law.” 14th
Amendment to the U. S. Constitution “No State shall make or enforce any law which shall
abridge the privileges or immunities of citizens of the United States; nor shall
any State deprive any person of life, liberty or property without due process of
law; nor deny to any person within its jurisdiction the equal protection of the
laws.” Beech
Grove Investment v. Michigan Civil Rights Commission Michigan, 157 North Western
Reporter, 2d Series, pgs 213-232 Government jurisdiction does not extend into or onto real or
private property. “The right to
purchase [and hold] property is a fundamental right of citizenship beyond the
powers of the States to deny to any citizen.”
Property ownership cannot be cause for government to force or coerce
title-holder(s) of property to do anything against his or her will.
The title-holder has full control over their property and has the right
to non- interference from all other parties. Jones
v. Mayer Company, 392 U.S. 409 Private property is owned and controlled by private
individuals. There is no monetary
or proprietary interest that a government, at any level, has in controlling
property belonging to a private indivdual.
The property owner decides with whom to procure a contract, negotiate,
dispose of, or improve property. The
property owner has guaranteed full control over his own private property and no
ordinance, law or person under the color of law is to interfere with, violate or
deprive the property owner this Civil Right. Your
Honor, Maple Grove Township, a Municipal Corporation, does not have a
contractual, proprietary or monetary interest in my private property.
Where is the presentment of, and an agreement to a contract with Maple
Grove Township? Where is the Proprietary Interest of Maple Grove Township to
my private property? Where is the
Monetary Interest of Maple Grove Township to my private property? Maple
Grove Township, along with Mr. Lenz, the Administrator, Mr. Elsie, the Building
Inspector and Mr. Beldo, the Assessor have violated my civil rights as I have
presented above. Maple Grove
Township must show and prove that jurisdiction exists as a matter of law
according to Title 5 of the U.S. Code,
Section 556(d). I
pray for relief, by this Honorable Court, from persecution, coersion and
intimidation from Maple Grove Township, Mr. Lenz, Mr. Elsie and Mr. Beldo.
I ask this Honarable Court to dismiss this matter, WITH PREJUDICE.
